Nominated by Theodore Roosevelt on April 14, 1904, to a seat vacated by Hiram Knowles; Confirmed by the Senate on April 19, 1904, and received commission on April 19, 1904. Service terminated on March 30, 1910, due to appointment to another judicial position.

U. S. Court of Appeals for the Ninth Circuit
Nominated by William H. Taft on December 12, 1910, to a new seat created by 36 Stat. 539; Confirmed by the Senate on January 31, 1911, and received commission on February 8, 1911. Assumed senior status on January 31, 1928. Service terminated on November 30, 1928, due to retirement.

Commerce Court
Nominated by William H. Taft on December 12, 1910, to a new seat created by 36 Stat. 539; Confirmed by the Senate on January 31, 1911, and received commission on February 8, 1911. Service terminated on December 13, 1913, due to abolition of the court.
